Altonajet is an intermediary service platform that enables users to meet their private jet charter needs digitally. Through this platform, customers can receive flight offers from different private jet operators and make their reservations. Altonajet is not an airline carrier or flight operator; it does not operate any flights itself or provide transportation services. Flights will be performed by licensed air carriers (operators) with whom Altonajet collaborates or which are chosen by the customer. Altonajet only acts as an intermediary in concluding charter agreements and organizing flights between customers and certified carriers. The scope of services offered by Altonajet is limited to presenting flight alternatives to customers, taking reservations, processing payments through the platform, and providing necessary communication. In this context, no content offered on the Altonajet platform should be interpreted as a direct commitment to air transportation services. The actual execution of flights and all operational control are the responsibility of the relevant carrier operator; the captain pilot and operator have exclusive discretion regarding the safe planning, execution, or cancellation of the flight.
You can benefit from our services by becoming a member of the platform. By registering, you agree that all information you provide is accurate and up-to-date. To become a member of the platform, you must be at least 18 years old and have the legal capacity to enter into a contract. Each user can only open one account in their own name on the platform; accounts cannot be transferred or used by anyone else. The user is responsible for securely storing confidential information (such as passwords) necessary for accessing their account. Account security is your responsibility; you must protect the confidentiality of your account password and access information. If Altonajet detects suspicious activity in your user account, it may temporarily suspend your account or terminate your sessions for security purposes.
Users agree not to share their account information with third parties and to protect their accounts against malicious use. If you become aware that your account has been used without your permission, you must immediately inform Altonajet. Otherwise, Altonajet is not responsible for any damages that may arise from transactions made through your account. The company reserves the right to reject new membership applications or request additional verification information if it deems it necessary.
When booking a private jet flight through the Altonajet platform, payment for your chosen flight can be processed using a pre-authorization model. According to this model, a pre-authorization (authorization) block equal to the flight fare is placed on your credit card or payment method specified during booking. If the flight is confirmed and takes place, the pre-authorization amount is collected as the flight fare; if the flight does not take place, the pre-authorization amount is released and refunded. This ensures payment security before the flight and prevents the customer from incurring any financial burden for canceled flights.
Payment transactions are protected by security certificates and are processed using third-party payment infrastructures. Your credit card information is processed in accordance with international standards such as PCI-DSS and is not fully stored by Altonajet; payments are processed through contracted payment institutions. All prices on the platform are final amounts unless otherwise stated and may include taxes and fees. If any additional costs arise subsequently in connection with the flight operation (e.g., airport surcharges, fuel surcharges, flight time extensions, de-icing costs, etc.), these amounts may be invoiced after communication with the customer. The customer accepts responsibility for paying any reasonable additional costs that may arise until the actual departure of the flight and that have been communicated to them in advance.
After reservation confirmation, the customer's payment obligation arises. If payment is not completed within the specified time, your reservation may be cancelled or your flight may not be confirmed. Altonajet reserves the right to terminate the contract and cancel the flight in case of timely payment. After successful payment is received, Altonajet will send you a reservation and flight confirmation document. This confirmation document shows your flight details and that your payment has been received.
In all payments made through the platform, Altonajet acts as an authorized intermediary to receive payments on behalf of the carrier. While Altonajet transfers the flight fare collected from the customer to the relevant carrier operator, it may also deduct its own intermediary service fee from this amount as per the agreement. As a payment intermediary for carriers, Altonajet reserves the right to offset any payment received from the customer against any other debt the customer may have to that carrier, if necessary.
The customer (user) using the platform declares and undertakes to comply with all applicable laws, aviation regulations and these terms and conditions. When you book a flight through Altonajet:
The user agrees to comply with all applicable laws and regulations while using the platform. They also agree not to use any part of the platform for unlawful purposes, criminal acts, or without permission/authorization. Misuse of the platform (e.g., unauthorized access attempts, manipulating other users' bookings, creating false flight requests, sending spam, etc.) is strictly prohibited. If such actions are detected, Altonajet reserves the right to immediately suspend the user's access, terminate their membership, and take necessary legal action.
The customer acknowledges that any notifications will be deemed to have been served upon them. It is the customer's responsibility to promptly update any changes to their contact information. The customer is responsible for any failure to receive notifications due to incorrect or outdated contact information.
Altonajet strives to ensure that its platform and services are continuously, reliably, and error-free. However, in the event of interruptions, technical malfunctions, or force majeure events related to the technology infrastructure or third-party services, access to the platform or booking processes may be disrupted. Altonajet will make reasonable efforts to resolve such interruptions as quickly as possible. In the case of planned maintenance or system updates, we will provide advance notice whenever possible, indicating that services may be temporarily suspended.
Altonajet strives to ensure the accuracy of the information presented on its platform, including aircraft, flight routes, prices, and similar details, however, much of this information is provided by carrier operators. Therefore, liability for possible changes or typographical errors in flight details (aircraft type, seat capacity, range, estimated flight time, etc.) or prices is limited. The customer is responsible for reviewing all critical information before confirming their reservation. Last-minute aircraft changes or schedule revisions may occur due to carriers; in such cases, Altonajet will endeavor to inform the customer as soon as possible and offer alternative solutions.
Altonajet strives to provide 24/7 accessibility as part of its customer support services. Customers can contact Altonajet for any questions or issues before or after booking. Altonajet customer representatives will assist customers with matters such as pre-flight briefings, flight change requests, cancellation and refund procedures. However, since the cancellation/refund conditions of any flight are subject to the contractual terms of the relevant carrier, Altonajet is obligated to communicate and implement these conditions to the customer without any changes.
Platform security and integrity are important to Altonajet. Therefore, Altonajet reserves the right to take temporary or permanent measures when it detects accounts or transactions that compromise system security. Furthermore, in cases such as fraudulent bookings, suspected fraud, or indications of illegal activity, Altonajet has the right and, if necessary, the legal obligation to suspend or cancel relevant user accounts and report the situation to the relevant authorities.
Unless otherwise stated, the design, logo, brand name, software, and content (text, graphics, visuals, etc.) offered on the Altonajet platform belong to Altonajet and are protected by national and international intellectual property laws. Users,
You may not copy, reproduce, distribute, display, or commercially use Altonajet's content or brand elements without Altonajet's prior written permission. In the event of unauthorized use of any material on the platform, Altonajet reserves the right to pursue legal action.
Users agree not to upload, share, or engage in any actions that infringe upon any protected rights, such as copyrights, trademarks, or patents, belonging to Altonajet or third parties, while using the platform. If Altonajet determines that any user has infringed on intellectual property rights, it may remove the content and suspend the user account, depending on the nature of the infringement.
Altonajet does not guarantee that the services offered through the platform will be uninterrupted or error-free, or 100% suitable for a particular purpose. The platform provides services "as is" and "as available". By using the platform, the customer acknowledges and accepts these risks. Altonajet cannot be held responsible for interruptions or data loss that may occur due to technical malfunctions, internet outages, system errors, or problems caused by third parties.
Altonajet explicitly states that, as an intermediary service provider, flight operations are independent of the company itself, and that aspects of the flight such as safety, on-time execution, cancellation, and delays are entirely under the operator's control. The services we provide are aimed at establishing and coordinating air transport contracts; we do not undertake the air transport obligations ourselves. Accordingly:
Services will resume once the force majeure event ends; however, no compensation can be claimed for obligations that could not be fulfilled during the force majeure period.
Altonajet's total liability, in any event, is limited to the amount paid by the customer to Altonajet for the relevant service. This is the applicable upper limit only for situations arising directly from Altonajet's fault and for which compensation is awarded by a court. The customer agrees to indemnify Altonajet against any third-party claims arising from their own fault or negligence. For example, if the customer infringes a third party's rights by using the platform, or if the operator is fined due to a passenger's conduct, Altonajet has the right to seek recourse against the customer if it is obliged to make any payment as a result.
Modification of Terms of Use: Altonajet reserves the right to unilaterally modify or update these Platform Terms of Use. In such a case, the updated terms will be published on the platform with a new date. Changes take effect on the date they are announced. By continuing to use the platform after the changes, users are deemed to have accepted the new terms. Therefore, it is recommended that you periodically review the updates to the terms. You may also be notified of important changes via email or in-platform notification, but this is not an obligation.
Suspension/Termination of Access to Services: Altonajet reserves the right to temporarily or permanently suspend the services provided to the user in the following cases: (i) If the user engages in activities contrary to these terms or applicable legislation, (ii) If suspicion of fraud or security risk is detected, (iii) (iv) The user engaging in behavior that jeopardizes the operation of the platform, (v) Failure to fulfill payment obligations, (v) Altonajet deciding to suspend the service generally due to operational or technical reasons.
If Altonajet terminates a user account at its sole discretion, the user may be notified of the termination via email. The user's rights and obligations accrued up to the termination date (e.g., payment obligations for flights already taken, refund rights, if any) remain intact. The user also has the right to terminate their membership account at any time; account deletion requests will be processed within a reasonable time frame once submitted to Altonajet. However, users who delete their accounts or cease using the service remain liable for previously confirmed reservations that have not yet expired.
These Platform Terms of Use and all disputes arising from or relating to the use of platform services shall be governed by and construed in accordance with the laws of the State of Delaware, United States of America. Conflict of laws rules shall not apply. The parties agree to the exclusive jurisdiction of the courts of the State of Delaware to resolve any dispute arising from these terms. In this context, the competent courts and enforcement agencies within the boundaries of the State of Delaware shall have jurisdiction in the event of a dispute.
If the customer is a consumer and the laws of their country of residence contain mandatory consumer protection provisions, these mandatory provisions shall clearly apply. In all other cases, Delaware law shall apply, and the courts of Delaware shall have jurisdiction.
Severability: If any provision of these terms becomes invalid or unenforceable, that provision shall be deemed severable from these terms and shall not affect the validity of the remaining provisions. The parties may negotiate a replacement for the invalid provision with a provision that is closest to its intended purpose and is legally valid.
Other Agreements as Needed: For each flight reservation made by the customer using the platform, a separate Distance Selling Agreement will be drawn up between the relevant operator and the customer. A contract or aircraft charter agreement may be concluded. Altonajet may request a power of attorney from the customer to sign these agreements on behalf of the customer if necessary (see sample power of attorney template below). In case of any conflict between these platform terms of use and other flight agreements, the conditions relating to the specific flight shall take precedence.
